Josh/Zoey versus Toby/Ellie: as you say, at least Josh and Zoey have shared screentime, and presumably his "Charlie, this is a girl" remark can be interpreted to say he has noticed this biological fact. Anyway, so you're saying the Toby-inclined people sue Ellie, and the Josh-inclined fans sue Zoey - I assume this means Liz by virtue of having gotten the least screentime and being the mother of two children, and being the oldest isn't anyone's Sue instead of getting paired with Sam. Ts.
Creepy: I would say something about the age difference for a start, but in fairness, given that canon has paired up Leo with Jordan and Annabeth, that by itself is no obstacle. And given Sam/Mallory, Josh would be on well-tread ground regarding hooking up with a daughter of his boss and father figure as well. But Toby/Ellie is, err, unprecedented and definitely would beat them all for proving psychiatrists with work for years.
(Sidenote: rewatching Ellie, I noticed that her calling Danny to give him that "my father won't fire the surgeon-general" quote and his reaction, the genuine anger and the reconciliation at the end where he doesn't say "sorry for yelling" but tries to make her laugh and at first she refuses to but gives in as he keeps up with the string of medical speciality names, does resemble the Toby interactions a bit, but I'm not sure that makes for a relationship basis...)
It does occur to me that with Doug the lightweight philanderer, Vick the shy fruit-fly guy, and Jean-Paul the French caricature, all three Bartlet girls seem to have deliberately picked guys unlike Dad. With Charlie being something of an exception; not that he resembles Jed, but he's not a light-weight. And he's the one Zoey broke up with...
